In the United States when you get a registered trademark it is issued by the United States Patent & Trademark Office http://www.uspto.gov/main/trademarks.htm And there is a fee to register. There are many firms that do all the paperwork for you, but at the end of the day it is the government that is issuing the trademark. So what did I say that was false? I clearly said the TM can be used by anyone and the R can only be issued by the government.
