I'll try to give some guidelines, but this is a very subjective question that could apply to any copyrighted material. Can I change a few words in a novel and issue it as my own? What if I change all the names? What if I change the ending? What if I use the same title and the same opening sentence, but change the rest? What if I mechanically change all the variable names in a program? What if I translate the program line by line into another programming language? There is no black and white answer to this. Ultimately a judge who has never programmed before in his life will decide in favor of the party with the highest-priced lawyers.
